Terms of Service

Working terms for using SmartRestro.

Effective July 31, 2026.

Service notice. SmartRestro is actively developed. Features, limits, and availability will change as the service evolves. Please keep your own copy of important restaurant and menu information.

1. Agreeing to these terms

These terms apply when you visit SmartRestro, create a draft or account, publish a restaurant website, or use another SmartRestro feature. If you use SmartRestro for a restaurant or other organization, you confirm that you are allowed to act for it. If you do not agree to these terms, do not use the service.

2. What SmartRestro does today

SmartRestro helps owners create and host informational restaurant and menu websites. The service can suggest place information, extract a menu from a website, image, or PDF, host owner-provided photographs, and publish owner-reviewed content.

SmartRestro does not provide online ordering, payment processing, delivery, table reservations, waitlists, or point-of-sale services. Links to maps, social networks, booking services, email, or other outside services take you to a third party whose own terms apply.

3. Drafts and accounts

You can start a short-lived draft without an account. Publishing, menu extraction, image uploads, and ongoing management require an account. You are responsible for activity through your session and for keeping access to your email or Google account secure. Tell us promptly if you believe somebody has used your account without permission.

4. Your content and permission to use it

As between you and SmartRestro, you keep the rights you have in restaurant information, menus, photographs, logos, and other material you provide. You give SmartRestro a non-exclusive, worldwide, royalty-free license to host, copy, resize, process, display, and distribute that material only as needed to operate, secure, and improve the service and your published website. This permission ends when the material is deleted, except for temporary backups, security records, and material we must retain for legal or abuse-handling reasons.

You must have permission to publish the restaurant’s content and must not upload confidential records, payment information, personal identity documents, or material that infringes another person’s rights.

5. Owner review is required

Google place information, AI menu extraction, suggested links, photographs, maps, and other provider-assisted content can be incomplete, outdated, or wrong. You must review all content before publishing and keep it current—especially prices, hours, ingredients, allergens, dietary labels, accessibility details, and contact information. SmartRestro does not certify food safety, allergen, nutritional, or regulatory information.

Use of Google Maps features is also subject to the Google Maps additional terms and Google Privacy Policy.

6. Published websites are public

Publishing makes the approved restaurant details, menu, photographs, and links available to anyone on the internet and potentially to search engines. Do not publish anything that should remain private. SmartRestro may remove or unpublish content while reviewing an ownership, accuracy, privacy, copyright, safety, or abuse report.

7. Acceptable use

You may not use SmartRestro to:

  • impersonate a restaurant or misrepresent your authority;
  • publish unlawful, deceptive, harmful, infringing, or malicious content;
  • upload malware or attempt to access private networks, accounts, or systems;
  • circumvent limits, interfere with the service, or automate abusive traffic; or
  • use provider data in a way that violates the provider’s terms.

We may limit, suspend, or remove access when reasonably necessary to protect the service, providers, restaurant owners, or the public.

8. Service availability

The service is provided on an “as available” basis. We may add, remove, or change features and limits; pause sign-ups; correct or remove content; or discontinue the service. We will try to give reasonable notice before a change that materially affects existing published websites, but urgent security, legal, or provider issues may require immediate action.

We do not promise uninterrupted operation, permanent storage, a particular search ranking, custom-domain availability, or continued access to any third-party provider. Public pages are designed to keep rendering when an enrichment provider is unavailable, but some content or features may be reduced.

9. Pricing and payment

The free plan remains free. SmartRestro Pro is sold per restaurant at the price shown on our pricing page, billed monthly in advance. A subscription covers a set number of restaurants; adding another restaurant to your subscription costs one more per-restaurant fee, and the amount is shown to you for confirmation before it is charged. Adding a restaurant part-way through a billing period is prorated for the remainder of that period.

Payments are processed by our billing provider, Chargebee. Card details are entered on their secure page and are never collected or stored by SmartRestro. You can cancel at any time from your account; cancellation takes effect at the end of the period you have already paid for, and we do not refund unused time unless the law requires it. Taxes may be added depending on your location. We will give notice before changing the price of an existing subscription.

If a payment fails, we may retry it and, if it continues to fail, return the account to free-plan limits. Published restaurant websites and connected domains remain available and their content is retained.

This means the account cannot add another restaurant or connect a new custom domain unless Pro access becomes active again.

10. Ending use

You can unpublish a website, remove photographs, export your SmartRestro data, or request deletion through the restaurant editor. Deletion applies to SmartRestro website data; it does not automatically delete the shared sign-in identity used by our authentication system. Certain abuse reports, security records, and provider cleanup records may be retained or anonymized as explained in the Privacy Notice.

11. Disclaimers and responsibility

To the extent permitted by law, SmartRestro is provided without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. You are responsible for your content, your restaurant’s compliance obligations, and decisions made using provider-assisted information.

To the extent permitted by law, SmartRestro is not responsible for indirect or consequential losses, lost profits, lost data, reputational harm, provider outages, or losses caused by inaccurate owner-approved content. These terms do not limit rights or liabilities that the law does not allow us to exclude.

12. Changes and contact

We may update these terms as the service changes. We will update the effective date and, when practical, give notice of material changes. Continuing to use the service after an update means the updated terms apply to future use.
